Welcome to Gmotivate ("we", "our", or "the Company"). Please read the following terms and conditions together with our PRIVACY POLICY in depth before accessing any of our online services. If you have any concerns or are uncertain, we recommend that you seek further clarification.

1. ACCEPTANCE OF TERMS AND CONDITIONS

Before agreeing to being registered on the Gmotivate App, you must carefully read the terms and conditions as set out in this agreement which may be amended from time to time by Gmotivate. These terms and conditions will govern the use of the App before registration.

By accessing, using or registering on the Gmotivate app, you hereby expressly acknowledge and agree to be bound by this agreement, any future amendments and additions to this agreement as may be published from time to time.

2. CREATING AN ACCOUNT

By using the Gmotivate app you represent and warrant that you are of the legal age and have the required capacity to enter into binding contracts. That you have the authority and capacity to enter into this agreement and abide by the terms and conditions of this agreement.

3. USE OF THE SOFTWARE

You are granted a non-exclusive, non-transferable, limited license to use the Software for personal or commercial purposes, as applicable. You agree to use the Software in compliance with all applicable laws and regulations, and you will not:

• Use the Software for illegal or unauthorized purposes.
• Attempt to reverse engineer, modify, or tamper with the Software.
• Violate any intellectual property rights related to the Software.

4. INTELLECTUAL PROPERTY

All content and materials available on the Gmotivate App, including but not limited to text, graphics, software, and logos, are the property of Gmotivate or its licensors. You are granted no ownership rights over the App or any associated content.

5. User Accounts

To access certain features of the Software, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use of your account.

6. Limitation of Liability

The Software is provided on an "as is" basis. We make no warranties or representations about the accuracy or completeness of the Software. Gmotivate will not be liable for any damages arising from your use of the Software, including direct, indirect, incidental, or consequential damages.

These Terms of Use are governed by the laws of Kenya. Any disputes arising from the use of the Software shall be resolved in the courts of Kenya.

As Gmotivate we value your privacy and are committed to protecting it. Your personal data is important to us and for this reason we would like to make sure you know how we use and protect it. This ensures that our operations remain secure and efficient, in order to effectively deliver our services to you. Where the recipient of your personal information is a thrid party outside of Kenyas jurisdiction we will ensure that all reasonable steps are taken to ensure that your personal information is protected.

To ensure that your personal data is well protected , we have put in place physical and technical measures to safeguard your information. i.e we ensure that all contracts we get into have confidential and data protection clauses. We also ensure that all third parties that we deal with have put in place data protection policies in line with the Data Protection Act, 2019

HOW LONG DO WE RETAIN YOUR DATA

For the reasons stated in this privacy notice, we retain your personal data for the purposes of effectively operating our business while you engage with us for as long as necessary to fulfill the purposes outlined in this Privacy Policy, or as required by law. We will delete, destroy and or stop uisng personal data as soon as we don’t want it.

CHIDRENS POLICY

Our Software is not intended for children under the age of 18. We do not knowingly collect personal information from individuals under 18. If we become aware of such data, we will take steps to delete it.

Under the Kenya Data Protection Act, 2019, you have the right to:

  You have the right to inquire on whatever personal data we hold about you and request for a copy of such information and an explantion on how we have used it

  Where information we hold about you is out of date or incorrect, you have a right to ask that we correct and or update such information
• Request deletion of your personal data under certain circumstances.
  You have the right to request that we delete personal data. However we may need personal details in order to provide our services to you.
• Object to the processing of your data or withdraw consent where applicable.
  You have the right to ask to stop using your data or change how we use it.
• The right to provide, change or withdraw consent
  Where we need to process personal data, we may ask for your consent . if you withdraw your consent or fail to offer your consent,we will not process your personal data. However we may not be able to provide our services to you
• The right to withdraw from direct marketing
  You may at any time choose to witthdraw your consent and we will stop sharing our marketing emails at any time
• Be informed as to the use to which your personal data is put
  The main aim of our privacy policy is to inform you on how your personal data will be used
